TERMS OF USE

BRUNET RIAHI, a professional services company with limited liability with share capital of €1,000, registered in the Paris Trade and Companies Register under number 928308873, whose registered office is located at 15, rue Soufflot, 75005 Paris (hereinafter "BRUNET RIAHI") is the publisher of the www.brunetriahi-avocats.com Website (hereinafter the "Website") and all its tabs.

 

Consultation and use of the Website by any individual or legal entity (hereinafter the "Visitor") is subject to unreserved acceptance of these General Terms and Conditions of Use (hereinafter the "TCU"). The Visitor is hereby informed and fully accepts that consultation and use of the Website implies unreserved acceptance of the TCU.

ARTICLE 1 - PURPOSE OF THE TCU

These TCU constitute the contract between the Parties for the use and consultation of the Website. The purpose of the TCU is to set out and detail the respective rights and obligations of the Parties in this respect.

 

 

ARTICLE 2 - DESCRIPTION OF SERVICES

The services offered to Visitors consist of:

 

- Access to the Website ;

- The use of the Website, in particular the functionality for contacting BRUNET RIAHI; and

- Consultation of elements of the Website.

The Visitor is hereby informed and fully accepts that the Website is a showcase Internet page, purely informational, with the exception of the contact function.

ARTICLE 3 - CONFORMITY OF SERVICES

BRUNET RIAHI undertakes to perform the Services in a professional manner and in accordance with the practices of the company information website sector.

 

The performance of the Services by BRUNET RIAHI constitutes an obligation of means and not of result. 

 

BRUNET RIAHI undertakes to resolve all technical and informational anomalies on the Website as soon as possible after their discovery. The Visitor may not hold the existence and/or persistence of these anomalies against BRUNET RIAHI on the grounds of breach of contract.

 

 

ARTICLE 4 - WEBSITE ACCESS AND MAINTENANCE

Visitors may access the Website via a specific hypertext link or by using a search engine. 

 

Access to the Website is free.

 

The Website is accessible 7 days a week, 24 hours a day. However, BRUNET RIAHI reserves the right to change, modify or suspend, without prior notice, access to the Website for maintenance or any other legitimate reason.

 

BRUNET RIAHI may, without notice or compensation, suspend the Visitor's access to the Website for any reason it deems legitimate, including in particular the violation of these TCU.

 

Inaccessibility of the Website does not entitle the Visitor to any compensation whatsoever.

 

 

ARTICLE 5 - ENTRY INTO FORCE, DURATION AND TERM OF THE GUS

These TCU come into force on the Visitor's access to the Website for an indefinite period.

 

 

ARTICLE 6 - LIABILITY

As the Services are provided free of charge and BRUNET RIAHI's obligations are only of means, the Visitor may not hold BRUNET RIAHI liable for non-performance or partial performance of these TCU.

 

The Visitor undertakes to use the Services in a fair and lawful manner. BRUNET RIAHI reserves the right to take action against the Visitor in the event that his/her behavior in accessing, using or consulting the Website violates these TCU or any legislative or regulatory provisions applicable between the Parties.

 

 

ARTICLE 7 - PERSONAL DATA

As part of the Services, BRUNET RIAHI is required to process the Visitor's personal data

 

BRUNET RIAHI undertakes to comply with all its obligations under Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data of 27 April 2016 and Law No. 78-17 of 6 January 1978 on data processing, data files and individual liberties.

 

The Visitor may consult all information relating to data processing by BRUNET RIAHI in its capacity as data controller on the Website under the "Privacy Policy" tab. 

 

 

ARTICLE 8 - INTELLECTUAL PROPERTY 

All elements of the Website, including images, photos, text and trademarks, are protected under intellectual property law. Any reproduction, representation or adaptation in violation of the provisions of the Intellectual Property Code constitutes an infringement liable to incur the criminal and civil liability of the 

 

No authorization is granted to the Visitor for these elements.

 

 

ARTICLE 9 - AMENDMENT OF THE TCU

These TCU may be amended at any time by BRUNET RIAHI, without prior notice, according to technical developments made to the Website, changes in legislation or for any other legitimate reason. The version of the TCU binding between the Parties is permanently available on the Website. The Visitor is informed by notification on the Website of any changes to the TCU. The Visitor's silence upon being informed of this notification irrevocably presumes his acceptance.

 

 

ARTICLE 9 - ASSIGNMENT OF THE TCU

These TCU may be transferred at any time by BRUNET RIAHI, without prior notice and without the Visitor's authorization, to any third party of its choice. BRUNET RIAHI warrants to the Visitor the proper execution of the TCU by the third-party assignee, where applicable.

 

 

ARTICLE 10 - DISPUTES, APPLICABLE LAW AND JURISDICTION

The TCU are governed by French law.

 

After an attempt at amicable resolution between the Parties has been unsuccessful, the Paris courts shall have jurisdiction over any disputes relating to the conclusion, performance or termination of these TCU.
